Terms of Service

Important: This document is meant to set clear expectations between you and us. It is not a substitute for legal advice. If you need help interpreting these terms, consult an attorney.

1. Agreement

By accessing or using our websites, mobile experiences, newsletters, forms, or other services (collectively, the "Services"), you agree to these Terms of Service. If you do not agree, do not use the Services.

2. What we provide

Namaste Publication LLC publishes community journalism and related content (including articles, profiles, events, and digital magazine features). We may also display advertising and sponsored placements that are labeled or visually distinguished from editorial content where applicable. Advertising relationships do not dictate our independent editorial judgments, though sponsors may appear adjacent to or within designated ad spaces.

3. Accounts

Some features require an account. You agree to provide accurate information and to keep your credentials confidential. You are responsible for activity under your account. We may suspend or terminate accounts that violate these terms or harm the Services or other users.

4. Submissions, partner stories, and user content

When you submit partner story submissions, comments, media, or other materials ("User Content"), you represent that you have the rights to submit it and that it does not violate law or third-party rights. You grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, edit, adapt, publish, distribute, and display User Content in connection with the Services and our related marketing, including in print, digital, email, and social channels, unless we agree otherwise in writing. You retain ownership of your underlying work to the extent you hold it.

We are under no obligation to publish or respond to submissions. We may edit for clarity, length, style, or legal risk. We may remove User Content at any time.

5. Advertising and third parties

Advertisers are responsible for their own offers, claims, and landing pages. Inclusion of an advertisement does not constitute our endorsement unless expressly stated in writing. Third-party sites linked from the Services have their own terms and privacy practices; we are not responsible for them.

6. Intellectual property

Except for User Content you own, the Services and their content (including layout, branding, graphics, and software) are owned by Namaste Publication LLC or its licensors and are protected by copyright, trademark, and other laws. You may not copy, scrape, or exploit the Services beyond what is allowed by law or with our prior written consent.

7. Prohibited conduct

You will not misuse the Services, including by attempting unauthorized access, distributing malware, harassing others, scraping at scale without permission, or interfering with security or performance.

8. Matrimony

Matrimony profiles may be posted only for adults aged 18 or older, with that person's knowledge and agreement. If you post for a family member, you confirm you have their permission. Profiles must be truthful and must not include phone numbers, email addresses, social media handles, or employer names. Profiles are written by the people who post them, not by us. We review profiles before they appear and may approve, refuse, hide, or remove any profile, or ask the poster to change it, at our discretion; we do not rewrite profiles. Namaste Phoenix does not conduct criminal background checks or verify the identity of members.

We do not run background checks or verify the identity, age, marital status, or other claims of any member, and we do not guarantee any introduction, response, or match. Contact details are shared only when both sides agree, and what members do after that is their own responsibility. We are not responsible for the content of profiles or messages, or for the conduct of any member, on or off the Services. Never send money or share financial information with someone you have not met, and report suspicious profiles to us.

A matrimony pass gives access to send interest for the period shown at purchase. Passes are not refundable once used, except where required by law. Price and pass length may change for future purchases. If you are the subject of a profile posted without your permission, use "Request removal" on the profile or contact us, and we will hide it while we review the request.

9. Copyright complaints

We respect intellectual property rights. If you believe content on the Services (including a photo in a profile) infringes your copyright, send a notice to our designated agent with: your contact details; a description of the work; the page address of the material; a statement that you have a good-faith belief the use is not authorized; a statement, under penalty of perjury, that your notice is accurate and that you are the owner or authorized to act for the owner; and your physical or electronic signature. We will remove or disable access to material that is the subject of a valid notice, and we may terminate accounts of repeat infringers.

Designated agent: Namaste Publication LLC, connect@namastephoenix.com.

10. Disclaimers

The Services and all content are provided "as is" and "as available." To the fullest extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement. Editorial content is for general information and community interest; it is not professional legal, financial, medical, or other advice. Reliance on any information is at your own risk.

11. Limitation of liability

To the fullest extent permitted by law, Namaste Publication LLC and its owners, staff, contributors, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill, arising from or related to your use of the Services. Our aggregate liability for claims arising out of these terms or the Services will not exceed the greater of (a) USD $100 or (b) the amounts you paid us in the twelve months before the claim (if any).

Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the maximum permitted by law.

12. Indemnity

You will defend and indemnify Namaste Publication LLC and its personnel against claims, damages, losses, and expenses (including reasonable attorneys' fees) arising from your User Content, your use of the Services, or your violation of these terms or applicable law.

13. Termination

We may suspend or terminate access to the Services at any time, with or without notice, including for conduct we believe violates these terms or creates risk.

14. Governing law

These terms are governed by the laws of the State of Arizona, USA, excluding conflict-of-law rules. You agree that exclusive venue for disputes will be in state or federal courts located in Maricopa County, Arizona, subject to applicable law.

15. Changes

We may update these terms from time to time. We will post the updated version on this page and revise the "Last updated" date. Continued use after changes constitutes acceptance of the revised terms.
